NOTICE OF FINANCIAL INCENTIVE AND DATA COLLECTION AND USE
As further explained in the Official Rules, below, in exchange for completing a survey OFM is providing participants with a chance to win either an RSP-1000 Desk or Monitor Arms. The entry requirements and selection process are included in the Official Rules, below. The survey will request that the participant provide the following personal information categories: identifiers and protected classifications. Providing protected classification personal information is optional and will not affect a participant’s chances of winning.

Under California law, the chance to win free product in exchange for the collection of certain personal information may be considered a financial incentive. We are required to explain how the value you receive from this promotion is reasonably related to the value we receive from the personal information you provide to us. We use the personal information that you provide to us to better understand the demographics of individuals interested in purchasing our products. We have determined that the value that we receive from the use of your personal information for this purpose is roughly equivalent to the value of the chance to win one of the products noted above. We calculated the value exchange by using the following method: reviewing the potential value this information will have to our business. OFM will disclose this information to service providers and third parties, specifically its internet service providers, operating systems and platforms, and its parent company and affiliates. OFM will not sell this information.
You may opt out of participation by not completing the survey or, if you have already completed the survey or would like to request deletion of the information you provide in connection with the Sweepstakes by contacting us at any time at privacypolicy@hnicorp.com.

Eligibility:
The “2022 Survey Giveaway” promotion is open to anyone with a valid Twitter, Facebook, and/or Instagram account. Participants must be a U.S. resident and at least 18 years of age at the time the sweepstakes begins. The “2022 Survey Giveaway” (“Sweepstakes”) is void outside the United States, or where prohibited or restricted by law.
This Sweepstakes is sponsored by OFM, LLC (“Sponsor”). All employees, officers, directors and agents and their immediate families or any members of their households, regardless of relationship, of Sponsor or any advertising agency or other company involved with the design, production, execution or distribution of this Sweepstakes are not eligible to participate in the Sweepstakes or to win any prizes. Sponsor is promoting this Sweepstakes on Twitter, Facebook and Instagram, but those companies are not official sponsors of this promotion.
Any Sweepstakes entries received from an ineligible participant will be disqualified. By participating in this Sweepstakes, participants accept and agree to be bound by these rules and the decisions of the Sponsor, which shall be final on all matters. Sponsor reserves the right to modify the rules of the Sweepstakes in any way at any time, subject to state or federal law.
Sweepstakes Period:
The Sweepstakes begins on February 4, 2022 at 12:01 a.m. EST and ends on February 10, 2022 at 4:21 p.m. EST (“Sweepstakes Period”). All entries must be received and recorded by the Sponsor during the Sweepstakes Period to be eligible.
How To Enter:
To enter the Sweepstakes, participants must complete and submit Sponsor’s survey found at https://docs.google.com/forms/d/e/1FAIpQLSc7tAgLUz0wmuj5CuBofUI3w0QOGh-UKeJrVCQc4gF5kWSSeA/viewform?usp=sf_link. One entry per person is permitted. Duplicate entries will be rejected for entry in the Sweepstakes.
Sponsor is not responsible for lost, misdirected, late, unsent, incomplete, illegible or unintelligible entries or for inaccurate entry information, whether caused by the participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical or human error that may occur in the transmittal of any entry or the processing of any function on the participant’s computer system. Participant must notify Sponsor of any changed contact information within the Sweepstakes Period to remain eligible to win based on entry information. Sponsor reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these rules; or to be acting with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar response methods will void all such entries submitted by such methods.
Prize and Selection of Winner:
Sweepstakes’ participants will enter for a chance to win either RSP-1000 desk or Monitor Arms. The approximate retail value of the RSP-1000 desk is $175.00, and the retail value of the Monitor Arms is $84.00. Sponsor will award three (3) RSP-1000 desks and three (3) Monitor Arms; the first three names drawn will win a chair and the next three names drawn will win the Monitor Arms. A total of six (6) winners will be randomly selected among all eligible entries, and the chances of winning depend on the number of entries received. No transfer, assignment, cash redemption or substitution of any prize is permitted, except by Sponsor due to prize availability and then with a prize of equal or greater value.
The winners will be selected in a random drawing on February 14, 2022. Sponsor will notify the winners individually by email.
Winners must respond within five (5) days of being notified or the prize may be forfeited, and another Sweepstakes participant chosen. Winners must satisfactorily complete an affidavit of eligibility showing compliance with these Sweepstakes Rules, and must also sign a liability and publicity release, allowing Sponsor to use his or her information for advertising or other purposes. Failure to complete these forms may result in forfeiture of the prize. In the event that a winner is disqualified for any reason, the Sponsor may select an alternate winner by random drawing from among all remaining eligible entries.
Each winner is solely responsible for all applicable federal, state or provincial, and local taxes and any expenses associated with any prizes. Where the value of a prize is $600 or more, Sponsor is required to issue a Form 1099-MISC to the winner, which winner must complete and then return a copy to the Sponsor prior to Sponsor delivering the prize.
The Sponsor reserves the right, in its sole discretion, to modify, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security or fairness of the Sweepstakes. The Sponsor is not responsible for any human or technological error that may occur in the processing of the Sweepstakes nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this Sweepstakes, or otherwise.
Limitation of Liability and Dispute Resolution
Except where prohibited, each participant and winner accepting a prize agrees that: (a) all issues and questions concerning these rules shall be governed by Iowa law without giving effect to any principles of conflicts of law of any jurisdiction; (b) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Sweepstakes or any prize awarded shall be (i) resolved individually, without resort to any form of class action; and (ii) filed only in the state courts situated in Iowa, and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys' fees; and (d) under no circumstances will any participant or winner be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
